End User License Agreement (EULA)

IMPORTANT: This End User License Agreement ("EULA") is a legal contract between you and DNS Publishing, LLC d/b/a Who Sent That Text Message (a consumer service powered by VeriRoute Intelligence). By clicking "I Agree," creating an account, or using our Service, you agree to be bound by this EULA.
1. License Grant
Subject to the terms of this EULA, DNS Publishing, LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Who Sent That Text Message service ("Service") for your personal or internal business purposes.
2. License Restrictions
You agree NOT to:
- Copy, modify, or distribute the Service or any part thereof
- Reverse engineer, decompile, disassemble, or attempt to derive the source code
- Rent, lease, lend, sell, sublicense, or transfer the Service to any third party
- Remove, alter, or obscure any proprietary notices
- Use the Service for any unlawful purpose
- Use the Service to develop a competing product or service
- Access the Service through automated means (bots, scrapers, crawlers) without written permission
- Circumvent any technical limitations or access controls
- Share your account credentials with any third party
- Use the Service to store or transmit malicious code
3. Permitted Uses
The Service may be used ONLY for:
- Identifying unknown callers or text message senders for personal safety
- Verifying the identity of businesses or individuals contacting you
- Identifying potential spam, scam, or fraudulent communications
- Reconnecting with lost contacts where you have a legitimate relationship
- Business verification and fraud prevention for your own business
- Research purposes where permitted by applicable law
4. Prohibited Uses
YOU EXPRESSLY AGREE NOT TO USE THE SERVICE FOR:
- Stalking or Harassment: Tracking, monitoring, or surveilling any individual without their knowledge and consent
- FCRA-Regulated Decisions: Employment screening, tenant screening, credit decisions, insurance underwriting, or any other purpose covered by the Fair Credit Reporting Act
- Debt Collection: Locating debtors or collecting debts
- Skip Tracing: Locating individuals for legal process service, bail enforcement, or repossession
- Marketing: Building marketing lists, conducting telemarketing, or sending unsolicited communications
- Data Aggregation: Compiling, storing, or redistributing data obtained from the Service
- Discrimination: Making decisions that discriminate based on protected characteristics
- Illegal Activity: Any activity that violates federal, state, or local law
5. User Representations and Warranties
By using the Service, you represent and warrant that:
- You are at least 18 years of age
- You are located in the United States
- All information you provide is accurate and complete
- You will use the Service only for lawful purposes
- You will comply with all applicable laws and regulations
- You have not been previously suspended or removed from the Service
- You will not use the Service for any FCRA-regulated purpose
6. Intellectual Property Rights
The Service, including all content, features, and functionality, is owned by DNS Publishing, LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. This EULA does not grant you any rights to our trademarks, service marks, or logos.
7. Data Ownership and Usage
You acknowledge that all data provided through the Service, including phone number information, carrier data, and caller identification information, is licensed, not sold, to you for your permitted use only. You may not:
- Store or cache lookup results beyond your immediate need
- Create derivative works based on the data
- Sell, license, or distribute the data to any third party
- Use the data to create a database or directory
8. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password
- Enable two-factor authentication when available
- Immediately notify us of any unauthorized use
- Not share your account with others
9. Service Availability
We strive to maintain Service availability but do not guarantee uninterrupted access. We may:
- Modify, suspend, or discontinue any aspect of the Service at any time
- Impose limits on certain features or restrict access
- Perform maintenance that may temporarily affect availability
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, COMPLETENESS, OR RELIABILITY OF DATA
- UNINTERRUPTED OR ERROR-FREE OPERATION
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERIROUTE INTELLIGENCE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION OR WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless DNS Publishing, LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of this EULA
- Your violation of any law or third-party rights
- Any claim that your use of the Service caused damage to a third party
13. Termination
This EULA is effective until terminated. We may terminate your license immediately if you breach any provision. Upon termination:
- Your right to use the Service ceases immediately
- You must destroy any data obtained from the Service
- We may delete your account and all associated data
- Sections 6, 10, 11, 12, 14, and 15 survive termination
14. Governing Law and Dispute Resolution
This EULA shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.
BINDING ARBITRATION: Any dispute arising from this EULA shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware. The arbitrator's decision shall be final and binding.
CLASS ACTION WAIVER: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15. General Provisions
- Entire Agreement: This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and us.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
- Assignment: You may not assign this EULA. We may assign it without restriction.
- Amendments: We may modify this EULA at any time. Continued use constitutes acceptance.
